Avoiding Clogocracy

• If politically effective black boxes were developed, the temptation to use them would be almost irresistible.
• Indeed, political consultants might well see using these tools as required by their professional responsibility to help their candidates win.
• And once one candidate uses such an effective tool, the opponents could hardly be expected to resist by disarming unilaterally.
• Every bit of that information that companies or policymakers deny the machine would make it less effective.
• But there is no reason to automatically extend the First Amendment’s protection to the product of these machines.
